Welcome to BookMGT. These Terms of Service ("Terms") govern your access to and use of the BookMGT platform, website, and services (collectively, the "Service"). By creating an account or using the Service, you agree to be bound by these Terms.
BookMGT is an online booking and appointment management platform designed for service businesses. The Service allows businesses to create booking pages, manage appointments, staff schedules, and customer information. BookMGT also provides embeddable booking widgets and email notification features.
To use the Service, you must create an account and provide accurate, complete information. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must notify us immediately of any unauthorized use of your account.
You must be at least 18 years old to create an account. By registering, you represent that you have the authority to bind the business entity you represent to these Terms.
BookMGT offers several subscription tiers with varying features and limits. Subscription fees are billed monthly in advance. All fees are non-refundable except as required by applicable law or as explicitly stated in these Terms.
We reserve the right to modify pricing with 30 days' advance notice. Continued use of the Service after a price change constitutes acceptance of the new pricing. Payment processing is handled securely through Stripe.
New accounts may be eligible for a free trial period. At the end of the trial, you must subscribe to a paid plan to continue using the Service. We reserve the right to modify or discontinue the free trial at any time.
You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree not to:
You retain ownership of all data you submit to the Service ("Your Data"), including business information, customer records, and booking details. You grant BookMGT a limited license to use Your Data solely to provide and improve the Service.
You are responsible for the accuracy and legality of Your Data. You must obtain all necessary consents from your customers before collecting and storing their personal information through the Service.
The Service, including its design, code, features, and documentation, is owned by BookMGT and protected by intellectual property laws. These Terms do not grant you any rights to our trademarks, logos, or brand features.
You may not copy, modify, reverse engineer, or create derivative works based on the Service without our written permission.
Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your information.
We strive to maintain high availability of the Service but do not guarantee uninterrupted access. The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control. We will make reasonable efforts to provide advance notice of planned maintenance.
To the maximum extent permitted by law, BookMGT shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities, arising from your use of the Service.
Our total liability for any claims arising under these Terms shall not exceed the amount you paid to BookMGT in the twelve months preceding the claim.
You agree to indemnify and hold harmless BookMGT, its officers, directors, employees, and agents from any claims, damages, or expenses arising from your use of the Service, your violation of these Terms, or your violation of any rights of a third party.
You may cancel your subscription at any time through your account settings or by contacting us. Cancellation takes effect at the end of your current billing period.
We may suspend or terminate your access to the Service at any time for violation of these Terms, non-payment, or any other reason at our discretion. Upon termination, you may request an export of Your Data within 30 days.
We may update these Terms from time to time. We will notify you of material changes via email or through the Service. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
These Terms are governed by the laws of the State of California, without regard to conflict of law principles. Any disputes arising under these Terms shall be resolved in the state or federal courts located in San Francisco County, California.
